Prosecutors: Colorado shooting suspect threatened professor

DENVER (AP) ? The suspect in a deadly movie theater attack was barred from the University of Colorado campus for threatening a professor, weeks before he opened fire at a midnight showing of the new Batman movie, prosecutors said in court documents released Friday.

That conflicts with the university's statements that Holmes was denied access to non-public parts of the campus because he had withdrawn from school.

The name of the person has been blacked out. University officials did not immediately return a message seeking comment.

Just minutes before the shooting, Holmes tried unsuccessfully to call his university psychiatrist, defense attorneys have said.

Holmes also mailed a notebook to psychiatrist Lynne Fenton, a professor at the school, including violent descriptions of an attack, attorneys said. She never received the package addressed to her, and it wasn't discovered in a university mail room until after the shooting.

Defense attorneys don't want it to be used as evidence, saying it's protected by doctor-patient privilege. Fenton last saw Holmes professionally on June 11 before seeing him again in court on Aug. 30.

In the documents released Friday, prosecutors say the professor reported the threats, and Holmes was denied access to campus "as a result of these actions."

In other documents, defense attorneys say the prosecutors' allegations are false, based on university statements.

After weeks of secrecy surrounding the case, most of the documents filed in court were released to the public on Friday.

Holmes, 24, faces 152 charges in the July 20 shooting at an Aurora movie theater during a special midnight showing of the new Batman movie, "The Dark Knight Rises." The attack killed 12 people and injured 58 others.

The defense has a psychiatry expert on its defense team and plans to use him as an expert, giving further insight into a possible insanity defense by James Holmes, the documents showed.

Defense attorneys claim Holmes is mentally ill, raising the possibility that Holmes will plead not guilty by reason of insanity.

In court, prosecutors suggested Holmes was angry at the failure of a once promising academic career and stockpiled weapons, ammunition, tear gas grenades, and body armor as his research deteriorated and professors urged him to get into another profession. Chief Deputy District Attorney Karen Pearson said Holmes failed a key oral exam in June, was banned from campus and began to voluntarily withdraw from the school.

Outrage Over Philippine Cybercrime Law | SecurityWeek.Com

MANILA - A new cybercrime law in the Philippines that could see people jailed for 12 years for posting defamatory comments on Facebook or Twitter is generating outrage among netizens and rights groups.

The stated aim of the wide-ranging law is to tackle a multiplicity of online crimes, including pornography, hacking, identity theft and spamming, following police complaints that they lacked the legal tools to combat them.

However, the act also includes a provision that puts the country's criminal libel law into force in cyberspace -- but with far tougher penalties for Internet defamation than in traditional print media.

Anyone posting a libellous comment online, be it on Facebook, Twitter or anywhere else, faces a maximum prison sentence of 12 years and a fine of one million pesos ($24,000).

Meanwhile, newspaper editors and other trained professionals working in traditional media face prison terms of just four years and fines of 6,000 pesos for defamation.

The Cybercrime Act also allows authorities to collect data from personal user accounts on social media and listen in on voice/video applications, such as Skype, without a warrant.

Prominent Manila blogger Noemi Dado, who edits a citizen media site called Blog Watch, said unwary teenagers retweeting or re-posting libellous material could find themselves facing the full force of the law.

"Not everyone is an expert on what constitutes libel. Imagine a mother like me, or teenagers and kids who love to rant. It really hits our freedoms," Dado told AFP.

While harsh criminal libel remains in force in other parts of Asia, Dado said the new law sent the wrong signal in a country that overthrew the military-backed Ferdinand Marcos dictatorship just 26 years ago.

Dado, a lawyer's wife known online as the "momblogger", is among a group of critics campaigning for the libel element of the cybercrime law to be repealed.

Bruce Adams, Asia director for New York-based Human Rights Watch, said the law was having a chilling effect in the Philippines, which, with its population of almost 95 million, is one of the world's biggest users of Facebook and Twitter.

"Anybody using popular social networks or who publishes online is now at risk of a long prison term should a reader -- including government officials -- bring a libel charge," Adams said.

Five petitions claiming the law is unconstitutional have been filed with the Supreme Court. The petitions all say the law infringes on freedom of expression, due process, equal protection and privacy of communication.

The lone opponent when the bill was voted on in the Senate, Senator Teofisto Guingona, filed one of the petitions.

"Without a clear definition of the crime of libel and the persons liable, virtually any person can now be charged with a crime -- even if you just re-tweet or comment on an online update or blog post," Guingona told the Supreme Court. "The questioned provisions... throw us back to the Dark Ages."

The petitions all state that the law infringes on freedom of expression, due process, equal protection and privacy of communication.

Law professor Harry Roque from the University of the Philippines, who filed another, said the country was one of a shrinking number worldwide where defamation remained a crime punishable by prison.

He said the Philippines libel laws -- part of a penal code that was drawn up 82 years ago -- go against the trend in many advanced democracies, such as the United States and Britain, where defamation is now punished with fines rather than imprisonment.

Amid the public backlash, a number of senators who voted for the Cybercrime Act have started to disassociate themselves from it, with some even saying they did not read the provision on libel.

However presidential spokesman Edwin Lacierda has defended the law.

"The Cybercrime Act sought to attach responsibilities in cyberspace... freedom of expression is always recognised but freedom of expression is not absolute," he told reporters on Thursday.

Nevertheless, Lacierda said the law could yet be refined. He has called for critics to submit their concerns to a government panel that will issue by the end of the year specific definitions of the law, such as who may be prosecuted.?

Smartphone snaps help deter election fraud

Election fraud is a fact of life in Afghanistan. In 2009, protest over the validity of the presidential election led to nationwide bloodshed, and in parliamentary elections the following year nearly a quarter of the ballots were discredited.

Now a study suggests that a simple snap with a smartphone camera could help make elections fairer.

A team at the University of California, San Diego, wanted to determine whether monitoring election fraud with cellphones could make the democratic process more robust. Focussing on Afghanistan, they arranged for photos of electoral returns forms to be taken at each polling station across a certain area the morning after voting.

The electoral returns form is a record of the total votes for each candidate at that location, and is relatively easily to tamper with either at the polling station or en route to the national aggregation centre.

The team sent out local researchers to take pictures of the forms containing the final count result at more than 400 polling stations during the 2010 parliamentary elections. On the day of voting, around half of the stations in the study were told that this instantaneous record would be made the following day. The research, presented by Michael Callen of the university's Institute of Global Conflict and Cooperation at Growth Week in London this week, found that this announcement of monitoring reduced the amount of tampering by 60 per cent.

Comparing the photographs with records from the national aggregation centre, they found that this drop in tampering had the knock-on effect of reducing the number of votes for politically powerful candidates by around 25 per cent.

More influential candidates who have stronger political connections can tamper with the results, the team conclude, because they can provide protection for the election officials who would have access to the electoral returns form.

Despite the uncertainties surrounding the subject, Professor Ramon Miralles had the following to say, "Cloud computing is both the present and the future; we have to get out there, but not at any price". Professor Miralles is Co-ordinator of Auditing and Computer Security with the Catalan Data Protection Authority, Board member of the Spanish Chapter of the Cloud Security Alliance and Lecturer on ESADE's IP&IT Master Programme. Along similar lines, Daniel Gabarre, Attorney at the J. Isern Patent and Trademark Office added: "The cloud is the new computing paradigm; it's usually explained from the standpoint of the risks involved, but without taking into account that it can also represent a great opportunity for companies." Specific aspects of how this new storage system will be put into practice for businesses were detailed in the first session of the fourth edition of the IP&IT Forum (Intellectual Property and Information Society) held at ESADE Law School.

Loss of control
One issue that has caused most debate and concern among users is related to the security and storage of confidential data. In Professor Miralles' opinion, although the cloud is inherently "neither safe nor unsafe," the same cannot be said of how it is managed. "Cloud computing is synonymous with loss of control." This is how the professor defines the problem regarding security. The problem, as such, stems from the fact that the client contracting the service hands over data storage and management to a third party while remaining responsible for the information.

According to Professor Miralles, this problem is compounded by the lack of information provided by cloud computing suppliers: "We don't have enough information to carry out proper risk analysis so that the person responsible for this data can be sure of its proper management," he explained. This loss of control is amplified by a "lack of transparency from cloud computing service providers in terms of explaining to us the legal conditions under which these services are to be provided".

Responsibility for data
The security risks involved in cloud computing are highly related to the contractual relationship between the client and supplier providing these storage services. That is, the person responsible for handling the data is responsible for its safekeeping, regardless of whether it is in the hands of a third party. In addition, they should also verify that the provider complies with the legislative aspects regarding the protection of personal data. Therefore, Professor Miralles advised, "look for a provider who is will to sit down with you and negotiate the service terms."

Benefits of cloud computing
Despite the important aspects to consider when it comes to "getting on the cloud", there are also great potential benefits. According to Professor Miralles, it will bring greater economic efficiency and simplify the use of ICT, but it will also provide more possibilities in terms of using applications and creating new ways of accessing information. Furthermore, cloud computing is more environmentally friendly given that it "uses shared data processing centres that are more energy efficient," explained the expert.

LG has finally spilled the beans on the official specs of their weird interesting 5-inch 4:3 smartphone, the Optimus Vu: II. This is the latest model of the Vu available in the domestic market -- which for LG is Korea -- and some of the specs are bumped up a bit from what we know as the original Optimus Vu and LG Intuition here in the states, such as the battery, RAM and processor:

Abbott misstated credentials of spinoff CEO Gonzalez

(Reuters) - Abbott Laboratories for years misstated that the executive handpicked to head its pending pharmaceutical spinoff held both bachelor's and master's degrees, and on Thursday called the misinformation "an administrative error."

Richard Gonzalez, named last October as the future chief executive of AbbVie once the company splits its drugs and medical devices businesses, did not complete his college education or receive a college degree, Abbott said on Thursday.

His company biography had stated that Gonzalez, Abbott's head of global pharmaceuticals, received degrees from the University of Houston and the University of Miami.

The credentials flap follows the resignation in May of Yahoo Inc Chief Executive Scott Thompson after a controversy over a fake computer science college degree on his biography.

Crain's Chicago Healthcare first reported the Abbott discrepancy on Thursday, saying the company's regulatory filings from 2002 through 2007 stated that Gonzalez had a bachelor's degree from Houston and a master's from Miami, both in biochemistry.

Abbott has since corrected the educational credits in Gonzalez's biography on its website, which now states that he was a research biochemist at the University of Miami School of Medicine and attended the University of Houston, majoring in biochemistry.

"It was an administrative error when the bio was written many years ago. It wasn't identified right away," Abbott spokeswoman Melisa Brotz said in a telephone interview.

"The information on the website is correct. When we became aware of it we corrected it promptly," Brotz said, adding that the changes were made "quite a while ago."

The company is firmly standing behind Gonzalez, and said there was no deliberate attempt to overstate his educational credentials.

"There is no issue with respect to Mr. Gonzalez's educational background or his ability to lead AbbVie as evidenced by his distinguished 30-year career in which he has reached the highest levels of the company," Brotz said.

Shares of Abbott, which rose 13 cents to close at $69.32 in regular trading, were slightly lower at $69.06 after hours.

Abbott Chief Executive Miles White selected the 58-year-old Gonzalez to head up the new company after the spinoff, which is set for January 1.

White will remain in charge of Abbott, which will retain the medical devices, diagnostics, nutritionals and branded generics businesses. AbbVie, with Gonzalez at the helm, will be a pharmaceutical company with nearly $18 billion in annual revenue, nearly half coming from the blockbuster rheumatoid arthritis drug Humira.

Take Noam Gershony, who won gold for Israel yesterday in wheelchair tennis at the London Paralympics. Mr. Gershony, an Apache helicopter pilot, was injured and his co-pilot killed when their craft collided with another helicopter during Israel's 2006 war with Lebanon. After extensive rehabilitation, he took up surfing and wheelchair tennis.

The persistence he displayed in overcoming that ordeal no doubt came in handy during the Paralympic semifinals when he found himself losing to local favorite Jamie Burdekin of Great Britain. As in life, so on the court: He rallied back after the first set to defeat Burdekin ? advancing to the finals, where he bested the top-ranked player in the world, David Wagner of the US.

Gershony says he never expected to win gold at the 2012 Paralympics in London, and his modest, almost bashful smile upon wheeling up to the top of the podium said as much. Only one Israeli has ever won gold at the Olympic Games, windsurfer Gal Fridman in 2004. Gershony's gold, though captured on the less-heralded stage of the Paralympics, was much celebrated in the Israeli media this weekend.?

Great Britain crashed out of wheelchair rugby medal contention after a lacklustre display against Japan at the Basketball Arena.

Victory would have sent the host nation into a mouthwatering semi-final clash against unbeaten Australia, with another capacity 10,000 crowd guaranteed.

But Steve Brown's team were punished for a sub-standard second quarter performance that saw them outscored 13-4, which underpinned Japan's success.

Britain, fourth at the Beijing Paralympics in 2008, had high hopes of a medal in London with ambitions that they could mix it with Australia and current world No 1 team the United States.

Their only victory in Pool A, though, came against France on Thursday night, and Japan will now meet Australia with the United States tackling Canada, who scraped through following a 53-52 Pool B triumph against Sweden.

Britain shaded the opening quarter 14-13 after Aaron Phipps and David Anthony scored all their goals between them, but there were some early second-quarter alarms when Japan opened a five-point lead.

Mistakes started to creep in as Japan dominated possession, and Britain required the presence of their solitary female player Kylie Grimes to reshape their tactical approach.

Britain, though, continued to be guilty of conceding way too much turnover possession, and Japan took the quarter by a landslide scoreline, giving their opponents a mountain to climb.

There was no way back, with Japan retaining control on the back of a comfortable lead and sending Britain into minor classification games tomorrow and Sunday as the crowd began leaving long before the end.

Great Britain coach Tom O'Connor did not pull any punches as Japan celebrated their victory.

O'Connor said: 'It was all about trying to win a medal here, and we failed.

'We've got to lift the players now. We are looking to finish as high as we can, but the medal we were looking for is not there.

'When you get good funding from the Lottery and UK Sport, it's a horrible feeling when the medal is no longer attainable.

I spent a great deal of yesterday deeply distracted, profoundly stressed and extremely frustrated. The problem was getting my medical records transferred from Oregon Health Sciences University (OHSU), my ?home? hospital, where I am treated at the Knight Cancer Institute, to the Johns Hopkins Hospital (JHH), where my second opinion consults today and Monday are at the Kimmel Cancer Center.

That turned out to be an absolute nightmare.

Bear in mind that I have very good health coverage (in terms of US health insurance). I am a capable businessperson who takes good call notes, knows how to speak professionally to people even when I am under extreme stress, and has long experience in navigating complex corporate systems and policies, as well as specifically with being a cancer patient. In other words, I am well supplied with experience and skills to deal with this.

The problem appears to be systemic rather than any individual misperformance. Nonetheless, this was a comedy of errors which rapidly approached a deep problem for me as I prepared for my second opinion consultation with a medical oncologist at JHH. It went something like this:

On August 17th, I spoke to a staff member in OHSU?s Medical Correspondece office, that handles patient records transfers. I requested release of my records to JHH. I detailed the treating physicians, as I have had four of them over 4.5 years of living with Stage IV colon cancer with multiple metastatic presentations. I was assured they had all the information they needed, and everything would be taken care of.

On September 5th, i spoke to a staff member at the Kimmel Cancer Center (they are a patient intake specialist) to confirm all required material had been received. After assuring me that if anything were missing they would have let me know, they double checked at my insistence. JHH had case notes from one of my doctors, nothing from the other three.

That same day I called back and spoke to Medical Correspondence at OHSU again. Asked them to resend for my other three doctors.

Late in the afternoon I tried unsuccessfully to reach my contact at JHH to confirm receipt.

Yesterday morning, September 6th, I finally reached JHH, who informed me that they had received partial notes from a second doctor, and none from the remaining two.

I called back to OHSU Medical Correspondence and spoke to another staff member. They quite incidentally asked me which month this year I?d been seen in by these other doctors whose records were missing. When I said these records went back to 2008, the staffer was surprised. They then said they would take care of it.

OHSU then called me back to tell me that they could not get the faxes to go through to JHH. Something seemed to be wrong with the receiving fax machine.

I then spent several hours trying to coordinate communication directly between OHSU and JHH rather than playing operator to a series of failed communication attempts. I offered to have the records faxed to my virtual fax number, where I would receive them as .pdf files and could forward them on to JHH via email, but was told that individuals cannot receive patient record faxes. Not even me for my own records. (This is in direct contravention to both stated OHSU policy and Oregon state law, by the way.)

At that point, I was in a panic. If the medical records, including surgery reports and case notes, did not go through, my entire trip to Baltimore for the second opinion would be largely wasted.

As the day went on, I made and received another half dozen phone calls. OHSU and JHH had finally spoken directly. A new fax number was provided. Another incomplete fax was sent. I was forced again to mediate between the two hospitals. Eventually, all the records went through, though receiving even confirmation of that was difficult.

Some observations about all this, speaking in my professional capacity as a business process and business communications analyst:

  1. OHSU?s process is broken. When I made my initial records request I was never asked for the date range of treatment. In assuming same-year only, OHSU creates a problem for patients with long-term courses of treatment. I did not know to inquire about the date ranges, and it?s not an obvious question for a layman to think to raise.
  2. OHSU?s process is further broken in that they cannot detect when they have sent an incomplete fax transmission. As delivered page count is readily available within facsimile transmission protocols, this means there?s no functional monitoring in place.
  3. JHH?s process is broken in that their error checking with respect to records availability failed. Further, that error check failure was not noticed until I pushed the issue.
  4. JHH?s process is further broken in that their fax machine (or more likely, electronic fax board) associated with such a critical path function was defective, apparently without anyone noticing it. This means there?s no functional monitoring in place.
  5. As a patient, it is virtually impossible for me to facilitate direct communication between OHSU and JHH due to the widespread use of voicemail boxes and callbacks. This meant I had to play ?operator? and lose several hours or half a day or more to each failure point in the process.
  6. OHSU?s lack of willingness to directly send me my own records in contravention to both their own published policies and Oregon state law made a swift, simple solution to the problem impossible. Another process failure, and possibly an audit and accountability failure within OHSU?s own organization.
  7. The failure of both institutions to either properly implement the 30-year-old technology of fax machines and transmission monitoring, or to implement in any way the 20-year-old technology of electronic records transmission, which in either case would sidestep many of these legacy issues and significantly reduce the latency in the records transmission process, allowing swifter error detection and prompt resolution.

I was almost in the position of having wasted an enormous amount of time and money trying to buy myself an extra year or two of life with outside experts consulting on my late stage cancer, because OHSU could not fax a set of documents to JHH. Neither entity was capable of performing simple, proven error detection at the functional telecommunications layer. Neither entity was capable of performing simple error correction at the business layer on their own initiative. Resolving this situation required well over a dozen intervening phone calls from me personally, at a time when I am already very, very stressed by the fourth presentation of my cancer.

Someone without my business and communication skills would have been at a dead loss, and found their trip for the second opinion wasted. Someone with my skills who simply hadn?t followed up in the absence of news to the good or bad would have likewise been at a dead loss, trip wasted.

And this is merely one small part of the incredibly complex process that I have to go through as a cancer patient. This is what our medical system asks of people in their times of deepest need and highest stress. Finicky compliance, constant vigilance, and that the patient or their family have the freedom and flexibility and cognitive functionality to cope with technically trivial and highly avoidable process errors.

If you think our American healthcare system is the best in the world, try being seriously ill. While I have only very minor complaints about my quality of care at the delivery end, the business, administrative and financial wrappers around that delivery are onerous, punitive and bizarre, on their best days.

How do people who don?t have advanced educations, business experience and good communications skills do this? How many people die every year in this country because they simply can?t comply with the Byzantine requirements of the healthcare system? Do you seriously believe we don?t need healthcare reform in the United States? My experience is not an exception case, it is the norm, even for someone with good insurance coverage and strong life skills.

It?s bad enough that I?m sick with a disease that will almost certainly kill me. What I have to go through to receive treatment is a disgrace. And I am one of the lucky ones at that,

Tornado destroys home in southwest Wisconsin

Madison - Wisconsin emergency management officials say a tornado destroyed a home in southwest Wisconsin on Tuesday night.

Wisconsin Emergency Management spokeswoman Lori Getter said Wednesday that no one was injured when the EF2 tornado struck the home in Bloomington. She says it destroyed a home and damaged four outbuildings.

The National Weather Service says the tornado had winds between 115 and 120 miles per hour, and was on the ground for two minutes. Officials estimate that it traveled two-tenths of a mile and was 70 yards wide.

It touched down around 7:40 p.m. as part of a storm system that rolled across southern Wisconsin bringing rain, hail and strong winds.

Chilean teenager completes move to United

MANCHESTER, England (AP) -Chilean striker Angelo Henriquez has finally completed his move to Manchester United, two weeks after being granted a work permit to join the Premier League giants.

United manager Alex Ferguson has been scouting the 18-year-old Henriquez since 2008 and says the youngster "fits the profile of a United player - skilful, attacking and someone who plays the game with real flair."

Henriquez, who joins from Universidad de Chile and hasn't yet played for his country, will initially be used in the reserves or the under-21 team but could be given a run-out for the first team in League Cup matches.

Henriquez says "I am thrilled to be joining the biggest club in the world."

Weight loss groups back NYC's sugary drinks plan

NEW YORK (AP) ? The city's planned crackdown on super-sized sugary drinks got prominent backing Tuesday from Weight Watchers, Jenny Craig and other diet companies, who added their influence to the campaign ahead of a vote next week.

The announcement ? made at a press conference featuring Mayor Michael Bloomberg and a top Weight Watchers official ? was the latest in a volley of statements of support for both advocates and critics of the plan, which calls for restaurants, movie theaters, sports arenas, food carts and delis to stop selling sodas and other sugary drinks in servings larger than 16 ounces.

Bloomberg and other proponents call it a sensible way to encourage people to cut calories. Opponents see it as government overreaching and question its effectiveness.

To the diet groups, it's a tool that fits with their approach to making healthy eating easier.

"Today, we live in a world where despite our best intentions, it's oftentimes very difficult on your own to make the healthy choice," said David Burwick, president of Weight Watchers North America. "We all need to take more personal responsibility for our own weight and eating habits, but it helps to remember what a healthy portion size is in a world where super-size portions have become the norm."

The proposal is set for a Sept. 13 vote at the city Board of Health, whose members are appointed by Bloomberg. If approved, it would take effect as early as March.

Bloomberg has been the leading advocate for the plan, which follows other efforts to spur New Yorkers to mind what they eat. During his 11-year tenure, the city has barred artificial trans fats from food served in restaurants and compelled chain restaurants to post calorie counts on menus.

Still, the city spends roughly $4 billion a year on weight-related health problems, the mayor says. He sees limiting the serving size of sugary drinks as a meaningful step ? but not an inflexible order ? to keep people from downing calories they might not even think about.

"Nobody is restricting the amount of sodas you can buy or the amount of sodas you can drink," he said, noting that people would be free to purchase multiple 16-ounce cups or bottles if they liked. "It is simply using portion control to point out to you ... how many calories you are consuming."

Along with Weight Watchers and Jenny Craig, the creator of the South Beach Diet, the founder of The Best Life and other diet experts expressed their support. City Hall also has released a roster of kudos from people including physicians, elected officials, chef Jamie Oliver and filmmaker Spike Lee.

Critics, too, are counting their ranks.

An opposition group called New Yorkers for Beverage Choices said it has the backing of more than 2,000 businesses and 201,000 people. A New York Times poll last month showed that six in 10 New Yorkers opposed the plan.

Opponents say the city is overstepping its authority and infringing on personal freedom. And they call the diet companies' stance inconsistent with their own emphasis on letting people make food choices, rather than absolute limits.

"Restrictions and bans will do nothing to address the very complex issue of obesity," New Yorkers for Beverage Choices said in a statement Tuesday. "New Yorkers are smart enough to make their own decisions."

Some City Council members support the proposal; others have criticized it. Regardless, it isn't scheduled to come before them for a vote.

The rule wouldn't apply to lower-calorie drinks, such as water or diet soda, nor to alcoholic beverages or drinks that are more than half milk or 70 percent juice.

Japan to buy disputed East China Sea islands: media

TOKYO (Reuters) - Japan has agreed to buy disputed East China Sea islets, claimed by both Tokyo and Beijing, from their private Japanese owners, Japanese media said on Wednesday, a move likely to fuel tensions between Asia's two largest economies.

The uninhabited islands, known as Senkaku in Japan and Diaoyu in China, have long been a source of friction. Japan and China have competing territorial claims to the islets and surrounding fishing areas and potentially rich gas deposits.

The Japanese government will buy the islets for 2.05 billion yen ($26.15 million) and the owners will sign a contract soon, the Japanese dailies Asahi and Yomiuri said.

The planned purchase of the islands, controlled by Japan and claimed by Taiwan as well, will be approved in a cabinet meeting as early as mid-September, the newspapers said.

The row is part of a broader series of territorial disputes in the South China and East China Seas that have set China against U.S. regional allies such as Japan and the Philippines.

On Tuesday, China warned the United States not to get involved in the disputes, just as U.S. Secretary of State Hillary Clinton arrived in Beijing pledging to send a strong message on the need to calm regional tension.

The Japanese coast guard last month detained Chinese activists who sailed from Hong Kong and landed on the East China Sea islands, triggering anti-Japanese demonstrations in China.

Last week, a man ripped a Japanese flag from a car carrying Japan's ambassador in Beijing in the latest flare-up of the territorial row.

The Japanese government's plan to purchase the islets comes after Tokyo's nationalist governor, Shintaro Ishihara, proposed a similar plan earlier this year. The Tokyo metropolitan government sent a team of officials to waters near the islets at the weekend to conduct a survey. ($1 = 78.3900 Japanese yen)

White Sox regain sole possession of AL Central

CHICAGO (AP) - Gordon Beckham hit a two-run homer and Hector Santiago won in his first major league start as the Chicago White Sox beat the Minnesota Twins 4-2 on Monday night.

After falling out of sole possession of first place in the AL Central on Sunday night following a 1-6 road trip and being swept by the Tigers, the White Sox won the first of a 10-game homestand. They moved a game up on Detroit, which lost to Cleveland 3-2.

Many of the White Sox players watched the Tigers' last out before going out to stretch while manager Robin Ventura practiced his putting in his office.

The White Sox have won eight straight at home and 22 of their last 27 at U.S. Cellular Field.

Jamey Carroll hit his first home run in three seasons for the Twins, who are 25 games below .500.

Santiago (3-1) pitched five-plus innings and allowed one run on three hits. He struck out six and walked three. Santiago started the season as the White Sox closer and later moved to a middle reliever. He was sent to Triple-A Charlotte to be stretched out as a starter.

Santiago is taking Gavin Floyd's spot in the rotation. Floyd is on the DL with a sore right shoulder.

Addison Reed pitched a scoreless ninth for his 25th save in 29 chances. The White Sox needed six relievers to secure the win.

Home run leader Adam Dunn was 1 for 3 with a double after missing Chicago's previous two games with an oblique strain.

Twins starter Samuel Deduno (5-3) allowed two runs over six on six hits. He struck out three and walked three.

A.J. Pierzynski led off with a single in the second inning, two outs later, Beckham hit an 0-2 pitch from Deduno over the left-field fence for his 13th of the season.

Carroll hit his first home run since Aug. 9, 2009, with one out in the fifth inning to cut the White Sox lead to 2-1. The home run for Carroll snapped a streak of 1,348 at-bats without a homer, which was the longest active streak in the majors.

Ben Revere robbed Kevin Youkilis of extra bases in the fifth with a running catch on the left-center warning track.

Santiago got help from reliever Nate Jones and Donnie Veal as they stranded Darin Mastroianni at third in the sixth inning.

Youkilis doubled with one out in the seventh off Minnesota reliever Kyle Waldrop. Then with two outs Youkilis scored on Paul Konerko's single to extend the lead to 3-1. Youkilis earlier snapped out of an 0-for-19 skid and was 2 for 3 on the night.

Joe Mauer doubled in the eighth off reliever Matt Thornton and scored on Justin Morneau's single to get Minnesota back within one run.

Beckham gave the White Sox an insurance run with his third RBI of the game in the eighth. Alexei Ramirez hit a two-out single then stole second and scored on Beckham's single.

Browsers Beware ? Don't Click Anywhere!

You get an interesting looking email in your Inbox? it looks like it?s from a credible source so you quickly click where they ask you to. That?s where the trouble begins. That one click could infect your computer, grab sensitive data, capture your online searching history, download your entire contact list, etc., etc.

Hackers are using all kinds of sites like facebook and Twitter to infect your mobile devices.

Note the ad I recently got for a supposed new professional social network actually uses the facebook logo. That is supposed to lull you into thinking this site must be safe, right?? Nope.

When I researched ?the professional social network? on Google, predictably LinkedIn popped up first in the organic listing, then a whole list of articles about social networking sites. Nothing was an actual match for ?the professional social network?. Huh.

Then I searched for the site I thought was related to the email address of the sender ? ?something called?getinvolvednow.net. ?I found nothing on this score either.

Why? Because on closer inspection of the actual web address linked to the emai:

several red flags are obvious.

  1. the name ?- ?has lots of numbers around ?it ? your brain should be screaming ?RED ALERT ? DO NOT CLICK ANYWHERE?
  2. The word ?involved? was misspelled as ?invloved? and that domain was issues to someone in Germany in November 2011 ? here?s the URL where I found that info out.

Over the past month I?ve gotten bogus emails (with less graphics, but nonetheless very professionally designed ?with all the logos and disclaimers in the ?right? places) from PayPal, assorted banks that I don?t bank at as well as those I do claiming that I need to log on and update my data, Federal Express, The Better Business Bureau, etc.

The moral of the story ? bogus business ads are popping up everywhere. It may take a few independent searches using your choice of browser & search engine ? but avoiding potential bots, hackers, or viruses is well worth your time!

DON?T CLICK on anything until you reassure yourself that whatever ?you think is a credible business, non-profit, etc., actually is. A good rule of thumb is to never click ? just open your browser and Google the business or non-profit name in order to access their site directly. There you can locate the special or whatever the email is claiming to offer or ask for.

As soon as you?ve identified a SPAM or JUNK email ? alert the business by researching where they want you to forward any phishing or fraud attempts. Dispose of the bogus email in your Junk mail folder and then immediately delete all the contents in your Junk mail folder.

Phew: Jose Aldo walks away from motorcycle accident with just a few scratches

Jose Aldo was in a motorcycle accident in Rio de Janeiro over the weekend, and walked away. The UFC featherweight champ and main event star of upcoming UFC 153 had no issues after his motorcycle ran into a car.

According to Tatame and MMA Fighting, he suffered a swollen foot and some scratches, but that's not different from what he would encounter while training for his October bout with former UFC lightweight champ Frankie Edgar. To be on the safe side, his coach in Brazil ruled out any more motorcycle riding.

Perhaps this is a sign that the UFC's summer of bad luck is over. The UFC's champions and main eventers have had a hard time holding onto their fights. What the hell happened to fatherhood? - John Tamihere Column ...

I woke up to yet another Fathers Day and got to thinking 30 years ago the majority of us woke up to a house where Kiwi families for the most part had a male, female child or children and this was called the whanau or family unit. Most of the males and females were joined by way of a concept, a contract and undertaking called marriage. In most families the male called Father was the sole bread winner and deemed to be head of the whanau and the household. In many families the father also appeared to be the go-to-guy for most, if not all, decisions.

Rapid change has occurred to this family unit. The woman's liberation movement determined, with some validity, that they were as a gender tied to domestic duties and that this forum of second class citizenship had to be broken. New Zealand has a fine tradition in social change matters. We were the first democracy to award women the vote in 1893; in 1974 we had a huge debate over sterilisation, contraception and abortion; and The Kirk government election in 1972 brought in the Domestic Purposes Benefit (DPB) again for good reason.

It was acknowledged that women in a bad relationship needed financial support, given many women were not in employment and we all accepted that relief. The marketing and branding of women can do anything and that 'girls are as good as boys' has worked dramatically.

Kiwi boys now in education terms lag way behind the girls. In 1980 engineering studies consisted of 2% women, today it is 48%; Law School and Business school today have women in the majority at over 50%.

In the blink of an eye we no longer have a family. We have two people presently called caregivers, if you are lucky. Your child can now report you to the police or welfare. The connection between a parent's duty to their child is now ruled by a third party. The DPB has increased from 100 in the 1970s to tens of thousands in 2000.

The rise of the sole parent, the drop off in marriage and the sledge hammer of Rogernomics have delivered the absolute requirement that both men and women had to work and earn to get ahead. Childcare or outsourced parenting is now the norm of the modern family and the nation. The notion of a nuclear family and the role of the old father figure is no longer certain.

So on this Fathers day I feel like the Mayor of Hiroshima on the morning after he got hit by the atomic bomb, what the hell happened to fatherhood?

Does Your Advertising Make You the Obvious Choice to Do Business

There is a concept in business that we marketers call the confidence gap. The confidence gap is defined as a potential customers inability to determine whether the products or services of a given company are any better, different, or worse than the competition's.

The confidence gap exists in every imaginable industry and in most cases the gap is growing wider all of the time.

Case in point: go to the yellow pages and look under the roofing section (or any section for that matter) and see for yourself if, plus or minus 10%, every ad says basically the same thing. 'Dependability, service, 80 years of experience'.blah, blah, blah.'

Going by the yellow pages alone it's almost impossible to tell who will really offer the best service, the best overall value, and exactly what you need as a customer. It would be helpful if some ads said, 'We stink, we won't deliver on our promises, we'll quote you one price and then charge you another,' but they don't. Every company good or bad is essentially saying the same thing. As consumers we know that not all companies are equal ' but how can we tell? Hence, the confidence gap.

But, this problem is not isolated to the yellow pages. Take any medium ' TV, radio, print, or brochures and compare what competitive companies are doing. You'll see very quickly that there is almost no significant differentiation. Oh, sure, one company may have a red ad and another a blue ad. One company may have a catchy jingle and the other may not, but it's still hard to tell which company is actually better or even which company gives greater promise of being the best choice.

One area of marketing that is atrocious for most businesses is their brochure. Most brochures are loaded with clich?s, worn out phrases, and platitudes that don't mean anything. Like 'dependability, quality, and service.' Any company on the planet could make a claim like that and you would still have no clue if there business was any good or not.

So what about your brochure? Does it make you the obvious choice to do business with, or does it just widen the confidence gap?

Here is a quick 4-pronged test to give your brochure (or your other advertising) to see if it has the potential of singling your company out as THE go-to company.

1.Does your brochure clearly communicate your USP (Unique Selling Proposition)? Most companies don't have a clearly defined USP. Your USP is what makes you different, better, and unique from your competition. Here are a few famous examples: 'When it absolutely positively HAS to be there overnight.' Of course your know that to be FedEx. The success of this Fortune 500 company was built largely on the strength of this USP that they could absolutely deliver overnight. Here's another one ' 'Hot pizza delivered fresh to your door in 30 minutes or less or it's FREE.' Dominoes pizza, right? You see how they didn't claim to be the best tasting, the cheapest (or the most expensive); they were the fastest'guaranteed.

So what is your USP? Are you the fastest in your industry? Do you offer a level of service and expertise that your competitors can't touch? Does your product do what other products can't? If so, SAY IT! And communicate it clearly. Your USP should be the focal point for your brochure.

2.Are you showing or telling? I'm from Missouri the 'Show-me' state. I guess we are a group of 'we'll believe it when we see it' types. But I don't think this attitude is limited to Missouri, every consumer everywhere would rather see that your product or service will deliver rather than just hearing you talk about it. So how can you effectively SHOW how your product or service works in the confines of a brochure? There are several ways: 1. Testimonials. Good ones show exactly how your product or services have impacted a real person's life. 2. Charts, graphs, and comparison. If you can save people money create an easy to read chart or graph that shows how much you'll save them. If you outperform the competition show that in a comparison of some type. Show you product in use if possible. Showing is always more powerful and more persuasive than telling'

3.Are you speaking the customer's language or your own? Most brochures read more like a brag report or like the CEO patting him or herself on the back rather than offering valuable info to the prospect. Your brochure should be focused on your customer and his or her needs ' not just your company. Yes, you want to show that you have won awards and what not, but you have to go beyond just mentioning your accomplishments and show how you can enrich your customer's lives.

4.Are your speaking in specific or general terms? People are leery of generalities, but more trusting of specifics. If you say you will save people 'a ton of money' that is significantly less powerful than saying that on average your customers save 25% or $100 when they start using your product or service. If you say you are the fastest ' quantify how much faster you are and tell your customer why it should be important to them. Specifics are rich with meaning and are powerful'generalities are worthless. Anyone can say that they are the best. Only a few companies can give the proper specifics to prove it.

Here's your assignment: take your brochure or ads and compare it to your competition's brochures or ads. Now, try to imagine what your reaction would be if you had no previous knowledge of you company, your competitor's companies, or your industry. Would any of the brochures cause you to say 'wow ' I would be a fool not to do business with THAT company?'

My guess is that none will even come close. If your brochure is under performing then go to work on the four things mentioned above.

Don't let your brochure widen the confidence gap ' span that gap. That's where the money is'on the other side of the confidence gap.
